Terms of Service

These Terms of Service ("Terms") govern your access to and use of Examrix, including our website, question banks, digital learning tools, practice modes, timed examination modes, progress tracking, analytics, anonymised peer comparison, AI viva practice, Viva RealTalk Exams, subscription services, and any related products or services provided by Examrix.
Examrix is operated by Examrix Ltd., a company registered in Ireland under company number 822261, with its registered office at Castleway, Dublin, Ireland ("Examrix", "we", "us", or "our").
By accessing or using Examrix, creating an account, purchasing a subscription, starting a trial, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use Examrix.
These Terms should be read together with our Privacy Policy, Cancellation and Refund Policy, Cookie Policy where applicable, and any product-specific or offer-specific terms shown at checkout or during registration.
If there is a conflict between these Terms and any specific terms displayed at checkout or in a separate written agreement, the more specific terms will apply to the extent of that conflict.
1. About Examrix
Examrix is an online medical education and examination preparation platform.
Our services may include medical exam question banks, practice mode, timed examination mode, detailed answer explanations, educational notes and resources, user dashboards, progress tracking, performance analytics, anonymised peer comparison, AI viva practice, Viva RealTalk Exams, subscription management, account management, and related digital learning tools.
Examrix is intended to support examination preparation and medical education. Examrix is not a clinical decision-support tool and must not be used for patient care, diagnosis, treatment, prescribing, or clinical management.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase a subscription.
By using Examrix, you confirm that you are legally able to enter into these Terms; the information you provide to us is accurate and complete; you will use Examrix only in accordance with these Terms and applicable law; and you will not use Examrix for any unlawful, fraudulent, abusive, or unauthorised purpose.
Examrix is intended primarily for medical students, doctors, healthcare professionals, trainees, and examination candidates. However, use of Examrix does not create any professional, educational, regulatory, supervisory, or clinical relationship between you and Examrix.
3. Accounts
To access certain features, you may need to create an account.
You agree to provide accurate, current, and complete account information; keep your login details secure; not share your password or account access with another person; not allow another person to use your account; promptly update your account information if it changes; and notify us immediately if you suspect unauthorised access to your account.
You are responsible for all activity that occurs under your account, unless the activity is caused by our failure to apply reasonable security measures.
We may suspend or terminate your account if we reasonably believe that your account is being shared, your login credentials have been compromised, you have breached these Terms, your use creates a security, legal, operational, or intellectual property risk, or your use is fraudulent, abusive, excessive, or harmful to Examrix or other users.
4. Subscriptions, Payments, and Stripe
Some Examrix products and services require a paid subscription or one-off payment.
Our order process is conducted by our payment provider Stripe. For eligible transactions Stripe acts as Merchant of Record, and handles billing enquiries, refunds and returns for those orders.
Stripe processes payments, manages applicable taxes, issues invoices and receipts, handles renewals, processes refunds, and manages chargebacks or payment disputes. Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe's Consumer Terms.
When you purchase a subscription or paid product, you agree to provide accurate billing information and authorise Stripe to charge your selected payment method for the relevant fees, taxes, and renewal charges.
Subscription prices, billing periods, renewal terms, and taxes will be displayed at checkout or in your payment confirmation.
Unless stated otherwise, subscriptions may renew automatically until cancelled. You are responsible for cancelling your subscription before the renewal date if you do not want it to renew.
Cancellation and refund rights are governed by our Cancellation and Refund Policy, as well as any mandatory rights you may have under applicable consumer law.
We reserve the right to change our prices, subscription plans, features, or billing arrangements. Where required by law, we will provide notice of material pricing or subscription changes.
5. Trials, Promotional Offers, and Beta Access
Examrix may offer free trials, discounted subscriptions, promotional access, introductory pricing, beta access, or limited access offers.
Any specific terms for such offers will be displayed at sign-up, checkout, or in the relevant offer communication.
Unless stated otherwise, trials and promotions are available only once per user; eligibility may be limited; promotional access may be withdrawn if misused; trial access may convert into a paid subscription where this is clearly disclosed and payment details have been provided; and beta features may be changed, withdrawn, interrupted, or discontinued at any time.
We reserve the right to refuse, revoke, or limit promotional or trial access where we reasonably suspect misuse, fraud, duplicate accounts, or breach of these Terms.
6. Educational Use Only
Examrix is provided for educational and examination preparation purposes only.
Examrix does not provide medical advice, clinical advice, diagnosis, treatment recommendations, prescribing advice, patient-specific guidance, emergency medical guidance, clinical decision support, professional certification, or guaranteed examination success.
You must not rely on Examrix as a substitute for clinical training, professional judgement, formal guidelines, examination syllabi, primary textbooks, regulator guidance, institutional policy, or advice from qualified educators or clinicians.
Medical knowledge changes over time. Although we aim to provide high-quality educational content, Examrix content may be incomplete, outdated, inaccurate, or unsuitable for a particular purpose.
You are responsible for verifying important information against appropriate primary sources, guidelines, textbooks, examination materials, and professional standards.
Examrix question banks, mock examinations, viva simulations, scores, percentiles, analytics, and AI-generated feedback are designed for revision and practice only. They do not replicate, predict, or guarantee the content, structure, marking standard, difficulty, or outcome of any real examination.
7. Exam Body Non-Affiliation
Examrix is an independent educational platform. Unless expressly stated otherwise, Examrix is not affiliated with, endorsed by, sponsored by, or approved by any examination body, royal college, university, medical regulator, professional society, hospital, training scheme, or institution.
Examination names, abbreviations, trade marks, and institutional names are used only to identify the examinations for which users may wish to prepare.
8. AI Viva Practice and Viva RealTalk Exams
Examrix may provide AI-powered educational features, including AI viva practice, simulated oral examinations, automated questioning, answer analysis, feedback generation, and Viva RealTalk Exams.
These features may use third-party artificial intelligence providers, including OpenAI.
AI-generated content may be incomplete, inaccurate, inconsistent, outdated, or unsuitable for your needs. AI-generated feedback does not represent the judgement of an examiner, medical school, training body, royal college, regulator, employer, consultant, or clinical supervisor.
You agree that AI viva practice is for education and revision only; AI-generated feedback should not be treated as definitive or authoritative; AI-generated scores, comments, or recommendations do not guarantee examination performance; AI outputs must not be used for patient care, clinical decision-making, diagnosis, treatment, or prescribing; and you are responsible for independently checking important information.
You must not enter or upload patient-identifiable information, confidential clinical information, special category personal data, or unnecessary personal information into AI-powered features.
We may monitor, store, review, analyse, or process AI viva inputs and outputs to provide the service, maintain safety, improve functionality, investigate misuse, and comply with legal obligations, in accordance with our Privacy Policy.
We may modify, suspend, limit, or discontinue AI features at any time.
9. User Content
"User Content" means any content you submit, upload, enter, generate, or provide through Examrix, including answers, notes, prompts, feedback, comments, support messages, AI viva responses, and other materials.
You retain ownership of your User Content, subject to the licence you grant us under these Terms.
By submitting User Content, you grant Examrix a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, display, transmit, adapt, analyse, and use that User Content to provide Examrix to you; operate and improve the platform; provide AI viva and feedback features; provide analytics and progress tracking; investigate technical issues; detect misuse or breach of these Terms; comply with legal obligations; and create anonymised or aggregated data.
You confirm that you have all rights necessary to submit your User Content and that your User Content does not violate any law, third-party rights, confidentiality obligation, professional duty, or these Terms.
You must not upload, submit, reproduce, share, or request the reproduction of confidential, copyrighted, recalled, leaked, or unauthorised examination content, including real examination questions, station materials, mark schemes, examiner notes, or other protected materials. Examrix may remove such content and suspend or terminate accounts involved in such activity.
We may remove, restrict, or disable access to User Content where we reasonably believe it breaches these Terms, creates legal risk, infringes third-party rights, or may harm Examrix or other users.
10. Patient Information and Confidential Clinical Information
You must not upload, enter, submit, or disclose patient-identifiable information, confidential clinical information, or medical records into Examrix.
This restriction applies to all parts of Examrix, including AI viva tools, Viva RealTalk Exams, free-text answer fields, notes, feedback forms, support requests, uploaded files, user comments, and any other interactive feature.
If you refer to a clinical scenario, you must ensure that it is fully anonymised and does not identify any patient, colleague, hospital, institution, or other third party.
You are solely responsible for ensuring that your use of Examrix complies with professional confidentiality obligations, data protection law, institutional policy, and applicable clinical governance standards.
11. Intellectual Property
Examrix and its content are owned by or licensed to Examrix and are protected by copyright, database rights, trade mark rights, and other intellectual property laws.
Examrix content includes, but is not limited to, questions, answer options, explanations, educational notes, diagrams, images, exam simulations, viva prompts, AI viva structures, software, source code, design, branding, databases, analytics, user interface elements, platform structure, scoring systems, and written materials.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use Examrix for your own personal educational and examination preparation purposes.
You must not copy, reproduce, publish, distribute, sell, resell, licence, sublicense, or commercially exploit Examrix content; share questions, answers, explanations, screenshots, PDFs, notes, or platform content outside Examrix; create derivative question banks, competing products, study resources, flashcards, AI datasets, or educational tools based on Examrix content; scrape, crawl, mine, index, extract, download, or bulk export Examrix content; use Examrix content to train, fine-tune, evaluate, benchmark, or develop artificial intelligence systems or machine learning models; bypass technical restrictions, paywalls, rate limits, or access controls; remove copyright, trade mark, or proprietary notices; or use Examrix branding without written permission.
Any unauthorised use of Examrix content may result in suspension or termination of your account and may give rise to legal claims.
12. Acceptable Use
You agree not to use Examrix for any unlawful, fraudulent, harmful, or unauthorised purpose; to breach any applicable law, regulation, professional rule, or institutional policy; to infringe intellectual property, privacy, confidentiality, or other rights; to upload or transmit viruses, malware, or harmful code; to interfere with the security, integrity, availability, or performance of Examrix; to attempt to gain unauthorised access to accounts, systems, data, or infrastructure; to scrape, crawl, spider, harvest, copy, or extract data or content; to reverse engineer, decompile, or attempt to derive source code; to overload, stress-test, or abuse the platform; to create multiple accounts to avoid payment, limits, or restrictions; to share, sell, rent, transfer, or sublicense account access; to impersonate another person or misrepresent your identity; to submit false, misleading, defamatory, abusive, offensive, discriminatory, obscene, or unlawful content; to upload patient-identifiable information or confidential clinical information; to use Examrix in a way that harms other users, Examrix, or third parties; or to use Examrix content to build or support a competing service.
You must not upload, submit, reproduce, share, or request the reproduction of confidential, copyrighted, recalled, leaked, or unauthorised examination content, including real examination questions, station materials, mark schemes, examiner notes, or other protected materials.
We reserve the right to investigate suspected misuse and to suspend, restrict, or terminate access where we reasonably believe these Terms have been breached.
13. Account Sharing and Misuse
Examrix subscriptions are for individual use only unless we expressly agree otherwise in writing.
You must not share your login details; allow another person to access your account; use another person's account; sell, rent, transfer, or lend your account; create pooled, shared, institutional, or group access without authorisation; use automated systems to access or extract content; or attempt to avoid subscription fees or usage limits.
We may use technical and usage information to detect account sharing, scraping, credential misuse, excessive usage, or unauthorised access.
If we reasonably suspect account sharing or misuse, we may suspend or terminate your account without refund, subject to applicable law.
14. Third-Party Services
Examrix may use or integrate with third-party services, including payment processors such as Stripe; hosting and database providers such as Lovable; authentication providers; analytics tools; customer support tools; email service providers; AI service providers such as OpenAI; and other infrastructure or software providers.
Your use of third-party services may be subject to those third parties' own terms and privacy policies.
We are not responsible for third-party websites, platforms, products, services, content, or policies that we do not control.
Where third-party services are necessary to provide Examrix, you agree that relevant information may be processed by those providers in accordance with our Privacy Policy.
15. Links to Third-Party Websites and Resources
Examrix may contain links to third-party websites, textbooks, articles, guidelines, journals, examination bodies, institutions, or external resources.
These links are provided for convenience or educational reference only.
We do not control and are not responsible for third-party content, accuracy, availability, policies, or practices. The inclusion of a link does not imply endorsement.
You should review the terms and privacy policies of any third-party websites or services you access.
16. Accuracy and Availability of Content
We aim to provide accurate, useful, and high-quality educational content. However, we do not guarantee that Examrix content will always be accurate, complete, current, uninterrupted, error-free, or suitable for your specific examination.
Exam syllabi, clinical guidelines, medical knowledge, and examination formats may change over time. Examrix content may not always reflect the latest guidance, examination style, or local practice.
We may update, edit, remove, replace, restructure, or discontinue content at any time.
We do not guarantee that any particular question, topic, examination, or curriculum area will be included; that the content will match your actual examination; that use of Examrix will improve your score; that you will pass any examination; that AI feedback will be accurate or examiner-equivalent; or that all errors will be corrected within a specific timeframe.
17. Service Availability and Changes
We aim to keep Examrix available and functioning, but we do not guarantee uninterrupted or error-free access.
Examrix may be unavailable due to maintenance, updates, security work, technical failures, third-party outages, hosting or infrastructure issues, cyber incidents, excessive demand, or events outside our reasonable control.
We may modify, suspend, restrict, discontinue, or replace any part of Examrix at any time, including features, question banks, AI tools, analytics, subscriptions, pricing, or content.
We may update, improve, replace, add, or remove content and features from time to time. For paid subscriptions, we will not intentionally remove substantially all core functionality of a purchased product during the active subscription period without providing an appropriate remedy where required by law.
Where changes materially affect a paid subscription, we will act in accordance with applicable law and any specific commitments made at the time of purchase.
18. Content Moderation, Suspension Reviews, and Appeals
If we suspend, restrict, remove content, or terminate access because of suspected misuse or breach of these Terms, we may notify you where appropriate and lawful.
You may contact us at support@examrix.com if you believe a moderation, suspension, or termination decision was made in error.
We may decline to provide detailed information where doing so would compromise security, fraud prevention, intellectual property protection, legal compliance, or the safety of Examrix or other users.
19. Feedback and Suggestions
If you provide feedback, suggestions, ideas, corrections, feature requests, or other comments about Examrix, you agree that we may use them without restriction or compensation.
This includes using feedback to improve content, correct errors, develop features, improve AI viva tools, improve platform design, and develop commercial products or services.
You confirm that any feedback you provide does not infringe third-party rights or breach confidentiality obligations.
20. Privacy
Your submission of personal information through Examrix is governed by our Privacy Policy. Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information, including account data, subscription data, usage analytics, educational performance data, peer comparison data, and AI viva data.
By using Examrix, you acknowledge that personal information will be processed in accordance with our Privacy Policy.
21. Cancellation and Refunds
Your rights to cancel a subscription or request a refund are governed by our Cancellation and Refund Policy and applicable consumer law.
Unless stated otherwise, cancellation of a recurring subscription prevents future renewal charges but does not automatically entitle you to a refund for the current billing period.
Where you are a consumer resident in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection rules, nothing in these Terms limits your statutory rights.
22. Suspension and Termination
We may suspend, restrict, or terminate your access to Examrix if you breach these Terms; fail to pay applicable fees; your payment is declined, reversed, refunded, disputed, or charged back; you share your account or misuse the service; you infringe our intellectual property rights; you upload unlawful, harmful, confidential, or patient-identifiable information; your use creates security, legal, operational, or reputational risk; we are required to do so by law; or we discontinue the service or relevant part of the service.
You may stop using Examrix at any time. You may also cancel your subscription in accordance with our Cancellation and Refund Policy.
Termination does not affect any rights, obligations, or liabilities that arose before termination. Sections relating to intellectual property, user content licences, prohibited use, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution will continue to apply after termination where appropriate.
23. Consumer Digital Content and Digital Services Rights
If you are a consumer, Examrix will provide digital content and digital services in accordance with applicable consumer protection law.
Nothing in these Terms limits your mandatory rights where digital content or digital services are not supplied, are not as described, are not fit for purpose, or do not meet other statutory requirements that apply to your purchase.
If any part of these Terms conflicts with mandatory consumer rights, those rights will prevail to the extent of the conflict.
24. Disclaimer of Warranties
Examrix is provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, representations, conditions, and guarantees, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, reliability, availability, fitness for a particular purpose, non-infringement, and satisfactory quality.
We do not warrant that Examrix will be uninterrupted, secure, timely, or error-free; content will always be accurate, complete, or current; defects or errors will be corrected; Examrix will meet your expectations or requirements; AI-generated outputs will be accurate, reliable, or suitable; using Examrix will result in examination success; or the platform will be free from viruses, vulnerabilities, or harmful components.
Nothing in these Terms excludes or limits any statutory rights that cannot lawfully be excluded or limited.
25. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
To the fullest extent permitted by law, Examrix will not be liable for loss of profits, revenue, business, opportunity, goodwill, data, or anticipated savings; examination failure; professional, academic, regulatory, or career consequences; indirect, incidental, special, punitive, or consequential loss; loss arising from reliance on educational or AI-generated content; loss arising from third-party services or outages; or loss arising from unauthorised account access where you failed to keep credentials secure.
To the fullest extent permitted by law, our total aggregate liability to you for claims arising out of or relating to Examrix or these Terms will not exceed the amount you paid to Examrix for the relevant service in the 12 months before the event giving rise to the claim.
If you have not paid for the service, our total aggregate liability will be limited to EUR 100, to the fullest extent permitted by law.
Nothing in this section affects your mandatory consumer rights.
26. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Examrix, its directors, officers, employees, contractors, agents, service providers, affiliates, licensors, and partners from and against any claims, losses, liabilities, damages, costs, and expenses arising out of or relating to your breach of these Terms; your misuse of Examrix; your User Content; your infringement of intellectual property or other third-party rights; your upload or disclosure of patient-identifiable information or confidential information; your breach of applicable law, professional duty, or institutional policy; or your unauthorised sharing, copying, scraping, or commercial exploitation of Examrix content.
This indemnity does not apply where prohibited by applicable law.
27. Consumer Rights
If you use Examrix as a consumer, you may have mandatory rights under applicable consumer protection law.
Nothing in these Terms is intended to exclude, restrict, or limit rights that cannot lawfully be excluded, restricted, or limited.
If any part of these Terms conflicts with mandatory consumer rights, those rights will prevail to the extent of the conflict.
28. Institutional, Group, and Enterprise Access
Examrix may provide access through institutions, universities, hospitals, training bodies, employers, or enterprise customers.
Where your access is provided through an institution, separate terms may apply between Examrix and that institution.
Your individual use remains subject to these Terms unless we expressly state otherwise.
Institutional access may be limited, suspended, or terminated if the institutional agreement ends; your eligibility changes; licences are not renewed; payment is not made; the institution requests removal of access; or you breach these Terms.
Institutional reporting, if provided, will be handled in accordance with our Privacy Policy and any relevant agreement with the institution.
29. Changes to Examrix and These Terms
We may update these Terms from time to time.
When we make changes, we will update the "Last updated" date above. Where required by law or where changes are material, we may also notify you by email, in-app notice, or another appropriate method.
Your continued use of Examrix after updated Terms take effect means that you accept the updated Terms.
If you do not agree to updated Terms, you must stop using Examrix and, where applicable, cancel your subscription.
30. Force Majeure
We will not be liable for delay or failure to perform any obligation where the delay or failure results from events outside our reasonable control, including internet or hosting failures, cyber incidents, third-party service outages, power failures, labour disputes, natural disasters, war, terrorism, civil unrest, public emergency, government action, changes in law, pandemic or public health events, or failure of suppliers or service providers.
31. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable. If modification is not possible, the relevant provision will be severed. The remaining provisions will continue in full force and effect.
32. No Waiver
If we do not enforce a provision of these Terms, this does not mean that we waive the right to enforce that provision later.
Any waiver must be in writing to be effective.
33. Assignment
You may not assign, transfer, or sublicense your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms as part of a merger, acquisition, restructuring, sale of assets, financing, corporate reorganisation, or transfer of business.
34. Entire Agreement
These Terms, together with our Privacy Policy, Cancellation and Refund Policy, Cookie Policy where applicable, and any product-specific terms, constitute the entire agreement between you and Examrix regarding your use of Examrix.
They supersede any prior or contemporaneous agreements, communications, proposals, or understandings between you and Examrix relating to the service.
35. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or formation shall be governed by and construed in accordance with the laws of Ireland. Subject to any mandatory consumer rights you may have in your country of residence, the courts of Ireland shall have jurisdiction over disputes arising out of or relating to these Terms or your use of Examrix.
